FAQs

POSH basics and practical implementation questions.

What is POSH?

POSH refers to the Prevention of Sexual Harassment framework at the workplace. It helps organizations build safe workplaces through prevention, awareness, complaint redressal mechanisms, and legal compliance.

What is considered sexual harassment at the workplace?

Sexual harassment includes unwelcome behavior of a sexual nature, whether verbal, non-verbal, written, visual, digital, or physical, that creates an intimidating, hostile, humiliating, or offensive work environment.

What are different kinds of workplace sexual harassment?

Common categories include verbal remarks or jokes, inappropriate messages or emails, repeated unwelcome advances, sharing explicit content, boundary-violating physical behavior, and abuse of authority linked to sexual favors.

Why does an organization need a POSH trainer?

A trainer helps employees and managers understand expected conduct, complaint channels, bystander behavior, and accountability. Regular training reduces risk and improves confidence in reporting mechanisms.

Why is a POSH retainer useful?

A retainer provides ongoing expert support for policy updates, IC guidance, annual reporting, escalation handling, and changing compliance requirements throughout the year.

Is POSH training a one-time activity?

No. Effective POSH implementation requires periodic sessions for new joiners, annual refreshers, and role-based training for managers and Internal Committee members.

Can you support only annual reporting or policy refresh activities?

Yes. Services can be delivered individually or bundled under a broader compliance engagement.

Do you help with IC capability building and committee constitution?

Yes. We support committee constitution, role clarity, process documentation, and focused IC trainings designed to improve inquiry readiness and defensible reporting.

Can awareness sessions be customized for leadership and employees separately?

Yes. Sessions can be customized for different stakeholder groups based on their responsibilities and risk exposure.

What are the POSH legal requirements for an organization?

Under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, every organization with 10 or more employees must: constitute an Internal Committee (IC), formulate a written POSH policy, display the policy prominently at the workplace, conduct annual awareness programs, maintain complaint records, and submit an annual report to the District Officer. Non-compliance can attract penalties up to ₹50,000 and potential cancellation of business registration.

What is an external committee member under POSH?

The POSH Act mandates that every Internal Committee include at least one external member — a person from a non-governmental organization (NGO), an association committed to the cause of women, or someone with expertise in issues relating to sexual harassment. The external member is nominated by the employer but cannot be an employee of the organization, ensuring independence and impartiality during the complaint inquiry process. We offer qualified external committee member services on a retainership basis.
